After Blocking S. 386, Sen. Durbin Introduces RELIEF Act to Increase Legal Immigration

Once again, Sen. Mike Lee (R-Utah) asked for unanimous consent from the Senate this week to pass the Fairness for High Skilled Immigrants Act, S. 386 in the Senate and H.R. 1044 in the House, that would lift per-country caps for employment-based green cards, but Sen. Dick Durbin (D-Ill.) objected. Sen. Durbin used his objection to introduce new legislation, the RELIEF Act, which would substantially increase the number of green cards issued each year, including clear the existing backlog of employment-based green cards over five years.

The House of Representatives overwhelmingly passed H.R. 1044, the Fairness for High-Skilled Immigrants Act, 365-to-65. While the bill's title includes the word "fair", the bill, should it become law, would all but eliminate employment-based green cards for nationals from all but a handful of countries.

Tech Engineers Union Announces Opposition to Gang of Eight's Amnesty

The International Federation of Professional and Technical Engineers (IFPTE) has written a letter to members of the U.S. Senate asking them to oppose the immigration bill, S. 744. Specifically, IFPTE opposes the Schumer/Hatch amendment that passed during the Senate Judiciary Committe mark-ups earlier this month. The Schumber/Hatch amendment would increase the annual numbers of H-1B Visas.

After dealing with most of Title I ("triggers" and border security) last Thursday, the Senate Judiciary Committee continues its markup of the Gang of Eight's amnesty bill, S.744, today. Today's markup will mostly focus on Title IV of the Gang's bill, dealing with the guest-worker provisions. Several of the issues to watch for today include changes to the existing H-1B high-skilled worker visas and worker protections outlined in the Gang's bill.

Texas Tech Firm Indicted for H-1B Misuse

The Texas firm Dibon Solutions has been indicted by federal authorities for using the H-1B visa system to create an as needed" work force. The papers filed by the federal government detail the scam, saying the tech firm recruited foreign workers and sponsored them for H-1B visas but required them to provide consulting services to third-party companies in other locations.

A few years ago, the pharmaceutical giant Pfizer informed hundreds of tech workers in its Connecticut R&D facilities that they'd soon be laid off. Before getting their final paychecks, however, they'd need to train their replacements: guest workers from India who'd come to the United States on H-1B visas. House votes down motion to increase foreign workers with no visa offsets

During consideration of H.R. 6429, a bill that would replace the Visa Lottery with green cards for foreign students who graduate from U.S. colleges or universities with an advanced degree in a STEM field, Rep. Zoe Lofgren (D-Calif.) raised a motion to replace the bill with another version that would increase foreign worker visas with no offsets. The House, however, voted, with bipartisan support, to keep the existing version of the bill, with the visa offsets, intact.

Microsoft push for worker visas raises concerns, exposes loopholes

Microsoft is so eager to find qualified engineers and programmers for its thousands of vacancies that it has offered to pay a bounty to the government in exchange for extra visas in order to import more foreign workers.
 
The proposal, which also would raise fees on other corporations seeking to tap the additional visas, was intended to help jump start immigration reform that had stalled in Congress.

Tech firm says tech layoffs hit 3-year high during first half of 2012

A report issued on Monday by the tech placement firm Challenger, Gray & Christmas says that tech layoffs in the United States hit its highest level in three years during the first half of 2012. The firm's report says 51,529 planned job cuts within the tech sector were planned during the first half of the year.

This past week, three bills have been introduced by Senators from both sides of the aisle aimed at bringing more foreign STEM (science, technology, engineering and mathematics) workers to the U.S.  What the politicians and pundits are forgetting to mention is that there are eligible, U.S. workers out there to fill these jobs. I personally have friends who graduated this past week with engineering degrees and no job offers in sight.   

Global High-Tech Firm Accused of Visa Fraud

Information Technology firm and high-tech industry powerhouse, Infosys, is being accused of bringing low-paid foreign wokers to the U.S. illegally, CBS News is reporting.

The allegations come from Jay Palmer, a principal consultant at Infosys. According to Palmer, Infosys engaged in systematic practice of visa fraud. Palmer's charges are the center of a federal probe.

The media gave Education Secretary Arne Duncan a free pass last week, when he testified before Congress that a DREAM Act amnesty was necessary because there aren't enough U.S. workers to fill available jobs. Numerous studies, reports, testimony, and statistics scoff at any notion of a STEM worker shortage, but none of them were included in mainstream media stories that reported on Duncan's testimony. Few reporters challenge absurd claims like Duncan's, leaving many Americans uninformed about the crisis American STEM workers face.
